Seller and scope

These terms govern distance sales by Surfgear to consumers in Morocco. Seller: AGADIR WAVES, a Moroccan SARL with share capital of DH 100,000, Trade Register 28629 (Inezgane court), tax ID 53800855 and ICE 003299261000097. Products and availability

Check the model, essential specifications, size, colour and quantity before confirming. Availability reflects recorded stock; you will be informed of any unavailability discovered after ordering. No different model will be imposed without your agreement.

An item without a confirmed price is not available to buy. Missing details or photographs are indicated on the product page.

Prices, VAT and delivery

Prices are in Moroccan dirhams (MAD), including 20% VAT. The selected variant’s price and the total are shown in the summary before confirmation. Delivery across Morocco through Aramex costs DH 45 including tax. Delivery is free from DH 1,000 of products including tax, after any discount and excluding delivery charges, including a basket of exactly DH 1,000.

The applicable price is the price displayed and accepted when ordering, subject to statutory rights in the event of an error.

Reviewing and placing an order

1. Select products, options and quantities.
2. Review your basket and correct any errors.
3. Provide the required details and choose delivery.
4. Read the terms, summary and total before confirmation and the payment step.

A basket selection or a browser return does not by itself prove that payment has been accepted. Retain the summary and confirmation when a sale is actually confirmed.

Payment

Payzone integration is in progress. Live card payment is not available yet. Displaying payment network or provider logos does not mean a payment method has been activated.

Delivery and receipt

Delivery across Morocco through Aramex costs DH 45 including tax. Delivery is free from DH 1,000 of products including tax, after any discount and excluding delivery charges, including a basket of exactly DH 1,000.

The delivery time applicable to your order must be communicated; no unconfirmed 24-hour or 48-hour service is guaranteed here. Unless otherwise agreed, the statutory distance-sale performance period is thirty days from receipt of the order.

If an item becomes unavailable, you will be informed and any sums already paid refunded without delay, no later than fifteen days after payment under the applicable provisions. Report damage or a different item to customer service; your statutory rights remain unaffected.

Right of withdrawal

For distance sales covered by Moroccan law 31-08, you have seven days from receipt of the goods to withdraw without giving a reason or paying a penalty, subject to statutory exceptions. The period is extended to thirty days where the required information has not been confirmed in writing as required by law.

The direct cost of a withdrawal return is yours unless the law provides otherwise. For a seller error or defective item, contact us to arrange the appropriate remedy; this is distinct from simply changing your mind.

Returns and refunds

Contact us to arrange the return; prior contact is not a condition for exercising your statutory right within its time limit.

Handle the product carefully and return the accessories and items received. The full amount paid is refunded without delay and no later than fifteen days after a valid withdrawal is exercised. Statutory interest applies after that period as provided by law.

Statutory exceptions, including certain personalised goods or goods that cannot be returned because of their nature, are assessed case by case. No blanket exclusion applies here to sale items, wetsuits or swimwear.

Defects, warranties and complaints

Applicable statutory warranties remain in force and are separate from withdrawal rights. Any manufacturer’s commercial warranty does not replace them. For a complaint: contact@surfgear.ma — +212 752-510380. Include your order number and explain the issue; relevant photographs may help.

Data, records and disputes

The privacy policy explains data processing. Records needed for invoicing and accounting are retained for the applicable periods.

Moroccan law applies. Contact the seller first to seek an amicable solution; you retain the right to contact authorities, a consumer protection association or the competent court under the applicable rules. No exclusive jurisdiction clause detrimental to consumers is imposed.
